When labor and employment issues arise, you need to respond quickly. Solving difficult labor and employment law problems requires skill and experience. With nearly 50 legal professionals devoted to labor and employment law, Baker & Daniels provides the depth, breadth and knowledge to meet clients' most challenging objectives.

Our ability is reflected in the diverse number of clients who rely on us for their important employment matters. Baker & Daniels represents national, regional and local businesses. We understand the needs of clients vary by the type of enterprise because we work with a range of private sector businesses, including manufacturing, health care, service, retail, logistics, construction and child care. Our group also solves employment issues for public sector clients.

We defend employment litigation in federal and state courts and advocate before fair employment law practices agencies. Baker & Daniels' experience includes extensive jury trial and class action representation. Avoiding claims is on equal footing to defense. On a daily basis, our professionals provide personnel advice and client counseling on a variety of matters. We provide guidance on policies, supervisor skill set training, work force reductions, employment contracts and restrictive covenants, workplace safety and substance abuse issues, disability accommodation, leaves of absence, discipline and termination, and all personnel issues.

Our professionals listen to our clients' needs — and fashion practical, creative paths to reach their objectives with efficiency. We do not tell clients, "You can't do that." We prepare a p lan to achieve their goals. Our collaborative team brings decades of collective experience — 11 professionals possess more than 20 years of employer advocacy and 22 professionals have more than 10 years of employer advocacy.

Every employer faces the challenge of federal and state employment laws and regulations. We guide clients through issues under the Service Contract Act, Family and Medical Leave Act (FMLA), Fair Labor Standards Act (Wage and Hour), Davis - Bacon Act, Americans with Disabilities Act (ADA), Occupational Safety and Health Act (OSHA), Worker Adjustment and Retraining Notification Act (WARN) and Sarbanes-Oxley. Some of Baker & Daniels' professionals devote most of their practices to veterans rights, diversity, affirmative action and Office of Federal Contract Compliance (OFCCP) matters. Professionals in our Washington, D.C. office are leaders in immigration law compliance.

For many of our clients, no service is more valuable than our decades of skill in strong union avoidance and collective bargaining. Remaining non-union requires planning and effort. Baker & Daniels provides management training, strategies and coaching to achieve the goal. When National Labor Relations Board (NLRB) petitions or charges occur, we fashion and implement defenses. For many clients, dealing with unions is an accepted option, and we formulate and negotiate bargaining strategies that help them best achieve their goals. Our experience includes contract interpretation advice, defense of arbitrations, collective bargaining agreement negotiations, and managing union strikes and picketing.

Baker & Daniels advocates passionately for employers only, avoiding the mixed loyalties of employee representation. On a multistate basis, we represent employers such as Eli Lilly & Co.; Correctional Medical Systems; MasterBrand; H.H. Gregg; Trinity Health; Extendicare Health; Cummins, Inc.; Tenneco Automotive; EaglePicher; Zimmer, Inc.; and The Salvation Army. We also solve employment issues in the public sector for cities such as Indianapolis, Mishawaka and South Bend and school districts such as Indianapolis, John Glenn and South Bend.

The quality of Baker & Daniels' work is recognized regularly by others. Our labor and employment law group has the highest rating by Chambers USA: A Guide to America's Leading Business Lawyers, which also lists more of our professionals than any Indiana law firm. Baker & Daniels also is among the leaders in recognition by The Best Lawyers in America.

Attorneys in our group are the editors of the Indiana Employment Law Letter, a monthly subscription publication of M. Lee Smith Publishers in Nashville, Tennessee. We created the CD, It's the Law, sold by the National Child Care Association as its leading management training tool. We have authored, or co-authored, many publications of the Indiana Chamber of Commerce, including the Indiana Employment Law Handbook, Indiana Guide to Hiring and Firing, and Indiana Handbook for Supervisors.

Our attorneys are eager to work with your business to help achieve your goals and avoid employment law pitfalls.
