Construction & Insurance

Baker & Daniels' construction lawyers use an integrated approach to the wide-ranging set of legal problems that confront the construction industry. Many of the same lawyers who represent construction clients in disputes and litigation also are immersed in contracting and structuring projects to minimize risk and avoid such disputes in the future. Our construction lawyers operate on the cutting edge of innovation and technology both in the construction industry and in the way we provide services, whether it be leadership in Green Building, the fostering and development of design build delivery systems, national representation of automated systems providers or analysis of BIM data and issues.

Additionally, our insurance attorneys have worked with transportation, construction and engineering clients on creating captive insurance entities, as well as conducting insurance audits for clients to ensure adequate coverage amounts under existing insurance arrangements.

Experience

Our representative construction and insurance experience in the manufacturing and logistics industry includes:

  • Serving as General Counsel to the Philadelphia-based Control and Information System Integrators Association, or CSIA, a group of 200 engineering firms from around the world that are engaged in the automation of advanced manufacturing and process facilities.
  • Currently serving as safety counsel to the Associates General Contractors of Indiana (now the Indiana Contractors Association). In that capacity, we advise the ICA and its members on new rules, such as steel erection cranes and derrick and the application of OSHA's multiemployer liability policy for construction sites.
  • Conducting many project risk assessments based on a review of existing contract documents.
  • Serving as a member of construction project teams to assist with choosing a project delivery method, creating an OCIP or CCIP program, drafting a project labor agreement, developing a bonding strategy, writing a safety manual or creating the many interconnected project documents and manuals.
  • Consulting with one of the largest marine transportation and manufacturing companies in the United States regarding formation of a captive insurance entity.
  • Forming captive insurance entities for construction and engineering companies.
  • Conducting insurance audits (in conjunction with brokers) on behalf of large manufacturing clients to determine whether there are any significant coverage gaps.
